Possession of child pornography requires several elements to be proven by the prosecuting attorney for a conviction. The prosecuting attorney must prove that the personal alleged to have possession of the pornographic materials either knew or should have known that he or she possessed them. And he or she either must have known or should have known that the person in the photograph was under the age of 18 years.

Because of new software now available, charges alleging possession of child pornography and charges for using a computer to commit a child sex crime are two of Wisconsin law enforcement's favorites. These two charges are filed quite often in Dane County, as well as the surrounding counties of Sauk, Richland, Columbia and Green.

Presumption of Prison & Reporting

Under Wisconsin law, the charge of possession of child pornography carries with it a presumption of three (3) years in prison along with a surcharge of $500.00 per pornographic image.
