Self Defense

In a criminal battery prosecution, you are not received to prove that you acted in self defnese, but rather, the prosecuting attorney is required to prove that you did not act in self defense. The burden of proof rests on the prosecutor to prove beyond a reasonable doubt that the alleged defendant did not act in self defense.

Defense Of Another

Under Wisconsin law, you are entitled to defend a third person under the same circumstances as if they were defending themselves. In other words, your defense of another must meet the same burden of proof as if you were defending yourself.

Knowledge Of Prior Violent Behavior

If the alleged victim has acted in a violent manner in the past, and the defendant is aware of that previous behavior, those specific acts which the victim has done in the past many times are admissible in the present case to show that the defendant had a reasonable belief they needed to defend themselves.
