Defense of Property - A Defense to criminal battery

Wisconsin Criminal Defense

Under Wisconsin law, a person may use self-defense to defend his or her property. A person's property includes personal belongings, such as those things that a person caries on their person or in something closely held - like a purse, and the person's immediate surroundings. It also includes things that are not personal property, but rather property owned by the person, such as a home. Also see self defense and defense of another person.

If the alleged victim has acted in a violent manner previously, and the defendant is aware of that fact, those specific acts which the victim has done in the past many times are admissible in the present case to show that the defendant had a reasonable belief that self defense was necessary.
