Defenses To Drug Offense Charges

Defenses To Possession, Manufacturing, Intent Drug Charges

Collateral Attacks On Prior Convictions

If you have a prior drug conviction (prior's), one of the best ways to get a felony possession charge reduced to a misdemeanor possession charge quickly is to challenge your prior convictions.

A challenge to a prior conviction can be done in one circumstance: if on the first offense, you did not have a lawyer to assist you in that case. If that is your situation, an attorney can help you go back and challenge that conviction on the grounds that you did not waive your right to a lawyer. If that challenge is successful, the prior conviction cannot be used and the felony possession then becomes, in most instances, a misdemeanor.

Under Investigation For A Drug Crime

If you are under investigation for a drug related crime, even if you have not been accused or charged with a drug offense, you have a right to have an attorney present during ALL questioning.

:: Straight Talk ::

Police often tell people who are under investigation for a crime that they can and should answer all of the police officer's questions, that the suspect is not under arrest and therefore they need not have an attorney present, that they are simply conducting an investigation - or an investigation about someone else, or that they are really after the big guys - the drug importers or big time sellers. The police say these things to get you to cooperate with them and admit to things that you may not intend to admit to. Most importantly, all of those questions and answers often become the basis upon which they obtain a search warrant to search your home or other places where you go. And those routine investigations become the basis of the information that will be piled up in folders sitting on the prosecuting attorney's table in the criminal trial against you.

Know your rights - you have the right to remain silent and refuse to answer any questions. You have the right to have an attorney present during all questioning.
