Repeated Drug OffensesSecond or Subsequent Drug Related ChargesPrior ConvictionsIf you were charged with a drug related crime such as possession of a controlled substance, and were either found guilty by a court or jury trial or you pled guilty or no contest to the charge, then you were previously convicted of a drug crime. If your plea agreement both reduced the initial drug related criminal charge and charged you with something other than a drug crime, then you do not have a prior conviction for purposes of being tried as a repeat drug crime offender. Subsequent Charges With Prior ConvictionsIf you have a prior conviction for possession, simply possessing a drug is a felony. It does not matter whether or not you intended to sell or distribute the drug. A second (or subsequent) offense is a felony regardless of the drug you possessed or the weight you possessed.
