Substantial Battery Under Wisconsin Law

Under Wisconsin laws, substantial battery is a felony. Substantial battery is normally charged when an alleged victim has suffered stitches, a broken bone, loss of a tooth, or is knocked unconscious.

Felony Charge

A battery charge involving great bodily harm or substantial bodily harm ranges from a Class I Felony to a Class E Felony.

A Class I Felony carries a fine of up to $10,000, a prison sentence of up to three and one half years, or both. If the convicted defendant has prior convictions, the penalties can be increased.

A Class H Felony carries a fine of up to $10,000, a prison sentence of up to 6 years, or both, also with additional penalties for prior convictions.

A Class G Felony carries a fine of up to $25,000, a prison sentence of up to 10 years, or both. Additional sentences may be imposed if the defendant has prior convictions.

A Class F Felony carries a fine of up to $25,000, a prison sentence of up to 12 years, or both; priors can increase the sentence.

A Class E Felony carries a fine of up to $50,000, a prison sentence of up to 15 years, or both; additional penalties are also available if prior convictions exist.
